1. Definitions

• Platform: The SeekSwap mobile application and website
• User: Any person who creates an account and uses SeekSwap
• Item: Any physical object listed for exchange on the platform
• Swap (or Exchange): The agreement between two users to exchange items
• Content: Any data, text, photos, or information posted by users
• Swap Proposal: An offer from one user to another to exchange specific items

2. Eligibility

To use SeekSwap, you must be at least 18 years of age and have the legal capacity to enter into binding agreements.

We reserve the right to request proof of identity or age at any time. Accounts found to be operated by individuals under 18 will be immediately suspended and deleted.

3. Platform Role — Intermediary Only

SeekSwap acts solely as a neutral intermediary:

• SeekSwap is NOT a party to any Swap or Exchange between Users.
• SeekSwap does NOT buy, sell, exchange, own, store, ship, inspect, or handle any Items.
• SeekSwap does NOT guarantee the quality, safety, legality, or condition of any Item.
• SeekSwap does NOT guarantee the identity or reliability of any User.
• SeekSwap does NOT mediate or arbitrate disputes between Users.

4. User Obligations

4.1 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Listing Obligations

When listing an Item, you must provide accurate descriptions, upload genuine photographs, and ensure you are the rightful owner.

4.3 Exchange Obligations

When participating in a Swap, you agree to communicate honestly, deliver the Item as described, and complete the exchange within a reasonable timeframe.

4.4 Conduct Standards

You agree not to engage in fraudulent behavior, harass other Users, post defamatory content, or use the platform for commercial resale or spam.

5. Prohibited Items

Strictly prohibited: weapons, illegal drugs, stolen goods, counterfeit goods, hazardous materials, live animals, pornographic material, items infringing intellectual property, recalled items, and any item prohibited by law.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

7. Limitation of Liability

SEEKSWAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Maximum aggregate liability: €50.

8. Indemnification

You agree to indemnify and hold harmless SeekSwap from any claims arising from your use of the platform, violation of these Terms, or disputes with other Users.

9. Intellectual Property

The SeekSwap name, logo, and all related trademarks are the property of SeekSwap SRL. By posting Content, you grant us a non-exclusive, worldwide, royalty-free license to use your Content for operating the platform.

10. Account Termination

We may suspend or terminate your account for Terms violations. You may delete your account through app settings. See our Account Deletion page for details.

11. Dispute Resolution

Disputes between Users are the sole responsibility of the Users involved. Disputes with SeekSwap shall be submitted to the courts of Bucharest, Romania. These Terms are governed by Romanian law.

12. Modifications

SeekSwap may modify these Terms at any time. We will notify Users of material changes through the app or via email. Continued use constitutes acceptance.
